TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) constitute an agreement between you (“User”, “you”, or “your”) and TinyTails (“TinyTails”, “Company”, “we”, “us”, or “our”) governing your access to and use of the TinyTails mobile application, website, content, features, products, services, and related platforms (collectively, the “Platform”).

By accessing or using TinyTails, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not access or use the Platform.

2. ELIGIBILITY

By accessing or using TinyTails, you represent and warrant that:

• You are at least 13 years old; 

• You have the legal capacity to enter into a binding agreement; 

• Your use of the Platform does not violate any applicable laws or regulations. 

If you are under the age of majority in your jurisdiction, you confirm that you are using the Platform with the consent and supervision of a parent or legal guardian.

 

3. ACCOUNT REGISTRATION

To access certain features of TinyTails, you may be required to create an account.

You may register using:

• Email address; 

• Mobile phone number; 

• Third-party authentication providers such as Google or Facebook. 

You agree to:

• Provide accurate and complete information; 

• Maintain the security and confidentiality of your credentials; 

• Immediately notify us of any unauthorized use of your account. 

You are solely responsible for all activities conducted under your account. Users may create and manage multiple pet profiles under a single account.

 

4. PLATFORM PURPOSE

TinyTails is a social networking platform designed for pet owners and animal enthusiasts to:

• Create pet profiles; 

• Share photos, videos, and text content; 

• Interact with other users; 

• Discover pet-related content and services. 

TinyTails does not provide:

• Veterinary advice; 

• Medical diagnosis; 

• Professional pet care recommendations; 

• Emergency services. 

Content available on the Platform is intended for informational and entertainment purposes only.

 

5. USER CONTENT

The Platform allows users to upload, publish, transmit, and share content, including:

• Images; 

• Videos; 

• Text posts; 

• Comments; 

• Profile information. 

You retain ownership of the content you create and upload.

However, by posting content on TinyTails, you grant TinyTails a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to:

• Host; 

• Store; 

• Use; 

• Display; 

• Reproduce; 

• Modify for formatting purposes; 

• Distribute; 

• Promote 

such content solely for operating, improving, marketing, and providing the Platform.

This license terminates within a commercially reasonable period after your content or account is deleted, except where retention is legally required.

You represent and warrant that:

• You own or have the necessary rights to the content you upload; 

• Your content does not infringe any third-party rights; 

• Your content complies with these Terms and applicable laws.

 

6. PROHIBITED CONTENT AND CONDUCT

You agree not to use TinyTails to upload, publish, promote, distribute, or engage in any content or conduct that:

• Depicts or promotes animal abuse, cruelty, neglect, or violence; 

• Involves illegal pet trade or unlawful sale of animals; 

• Contains harassment, threats, hate speech, or abusive behavior; 

• Includes pornography or sexually explicit material; 

• Promotes illegal activities; 

• Violates intellectual property rights; 

• Contains malware, spam, or malicious code; 

• Attempts unauthorized access to systems or accounts; 

• Impersonates another person or entity; 

• Uses automated systems or bots without authorization. 

Commercial advertising, spam, or unauthorized promotional activity is prohibited unless expressly approved by TinyTails.

 

7. CONTENT MODERATION

TinyTails reserves the right, but is not obligated, to:

• Monitor content and activity on the Platform; 

• Investigate violations of these Terms; 

• Remove, restrict, or disable access to content that violates these Terms, applicable laws, or community safety standards. 

We may take moderation actions based on user reports, automated systems, internal review processes, or legal obligations. 

 

8. THIRD-PARTY SERVICES

The Platform may contain integrations, links, or connections to third-party services, including:

• Instagram; 

• TikTok; 

• Payment processors; 

• External websites and applications. 

Your use of third-party services is governed solely by the terms and policies of those third parties.

TinyTails is not responsible for:

• Third-party services; 

• Third-party content; 

• Data handling by third parties; 

• Availability or functionality of external platforms. 

9. PAYMENTS, SUBSCRIPTIONS, AND MARKETPLACE FEATURES

TinyTails may offer:

• Paid subscriptions; 

• In-app purchases; 

• Marketplace listings; 

• Premium features; 

• Advertising services. 

Payments may be processed through third-party providers such as Stripe, Razorpay, Apple App Store, or Google Play.

By making a purchase, you agree that:

• All purchases are final; 

• Payments are non-refundable except where required by law; 

• Pricing may change at any time; 

• Taxes may apply depending on your jurisdiction. 

Apple and Google may independently administer refund rights under their platform rules.

 

10. INTELLECTUAL PROPERTY

All intellectual property rights in the Platform, including but not limited to:

• Software; 

• Source code; 

• User interface; 

• Design; 

• Logos; 

• Branding; 

• Graphics; 

• Features; 

• Trademarks; 

• Content created by TinyTails

are owned by or licensed to TinyTails and protected by applicable intellectual property laws.

You may not:

• Copy; 

• Reproduce; 

• Modify; 

• Reverse engineer; 

• Distribute; 

• Commercially exploit 

any part of the Platform without prior written consent.

 

11. ACCOUNT TERMINATION AND DELETION

You may request deletion of your account at any time through the Platform settings or by contacting us.

Following a deletion request:

• Your account will enter a pending deletion state; 

• Permanent deletion may occur within thirty (30) days; 

• Certain information may be retained where legally required or necessary for legitimate business purposes. 

TinyTails may retain anonymized or aggregated data after deletion.

Apps supporting account creation are required to support account deletion functionality under Apple policies. 

 

12. DISCLAIMERS

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINYTAILS DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY; 

• FITNESS FOR A PARTICULAR PURPOSE; 

• NON-INFRINGEMENT; 

• ACCURACY; 

• RELIABILITY; 

• AVAILABILITY; 

• SECURITY. 

We do not guarantee uninterrupted or error-free operation.

 

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINYTAILS SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES; 

• INCIDENTAL DAMAGES; 

• CONSEQUENTIAL DAMAGES; 

• LOSS OF PROFITS; 

• LOSS OF DATA; 

• BUSINESS INTERRUPTION; 

• USER CONTENT; 

• THIRD-PARTY CONDUCT. 

Our aggregate liability shall not exceed the amount paid by you to TinyTails during the twelve (12) months preceding the claim.

 

14. INDEMNIFICATION

You agree to indemnify and hold harmless TinyTails, its affiliates, officers, employees, contractors, and licensors from any claims, liabilities, damages, losses, and expenses arising out of:

• Your use of the Platform; 

• Your content; 

• Your violation of these Terms; 

• Your violation of applicable laws or third-party rights. 

 

15. PRIVACY

Your use of the Platform is also governed by our Privacy Policy.

By using TinyTails, you consent to our collection, use, and processing of information as described therein.

 

16. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of Iceland.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Iceland.

 

17. CHANGES TO TERMS

We may update or modify these Terms at any time.

Material changes may be communicated through:

• App notifications; 

• Email; 

• Website notices. 

Continued use of the Platform following updates constitutes acceptance of the revised Terms.
